Dave is an experienced business litigation and real estate attorney who has been practicing law for 25 years.  He has litigated state and federal cases, including corporate, employment, real estate, partnership, securities law and other disputes.  He also has more than a decade of experience providing legal counsel to commercial real estate landlords and tenants, as well as providing advice to domestic and international clients in connection with a broad range of commercial real estate issues, from zoning and permitting, to acquisitions and dispositions and real estate financing matters.   His current clients include corporate and individual clients engaged in a broad array of civil disputes, as well as institutional and individual property owners to whom he provides real estate advice on an ongoing basis.

Prior to joining McCormack Suny, Dave served in a senior business and legal counsel role with Cummings Properties, one of the Commonwealth's largest real estate development, leasing and property management companies. He was responsible for providing advice on the firm's commercial development projects, leases, zoning and the firm's real estate disputes, including property management issues, bankruptcy and summary process matters.  In this capacity, Dave has negotiated hundreds of leases involving virtually every possible use, from retail operations to research and development operations. In particular, he has extensive experience negotiating leases with life sciences companies, including a thorough understanding of zoning/permitting issues, as well as experience negotiating the legal and business terms associated with the technical aspects of the facility being leased, which are crucial to a successful tenancy. 

Previously, Dave spent ten years as a commercial litigation attorney at Ropes & Gray (Boston) and Davis Polk & Wardwell (New York) and in-house litigation counsel with Cummings Properties. During this time, Mr. Suny first-chaired more than twenty state and federal court trials, as well as multiple arbitrations and other alternative dispute resolution procedures.

Recent Engagements: 

Real Estate:
• represented major transportation company in the negotiation of its 26,000 square foot
  office lease in Boston
• represented international real estate fund in the sale of 130,000 square foot suburban 
  office building
• represented regional waste disposal company in the permitting and approval of a Waste
  Transfer Station

• represented President of a regional cleaning company in a shareholder Freeze-out litigation
• Obtained $270,000 judgment after three-day bench trial in landlord-tenant litigation
• Representing major Boston-based mutual fund company in breach of contract claim seeking
  $1,000,000 in damages 
• Settled Wage Act Claim on behalf of Commissioned Sales person for three times the value
  of the unpaid wages at issue
